Terms of Service

By using Piktara ("the Service"), operated by Nisqure Ltd ("we", "us"), you agree to these Terms. If you do not agree, do not use the Service.

Piktara is an AI-powered photo curation service. You submit photos from connected services (e.g., Google Photos), and our AI analyzes and ranks them. You review the results and export your selected winners.

• You must be at least 16 years old to use the Service.
• You are responsible for maintaining the security of your account.
• You must provide accurate information during registration.

• You retain all ownership rights to your photos.
• You grant us a limited, temporary licence to process your photos solely for the purpose of delivering the Service.
• We do not claim any intellectual property rights over your content.
• You must have the right to submit any photos you upload.

• Pricing is per photo as displayed at the time of job creation.
• Payment is processed securely via Stripe before processing begins.
• Free 20-photo previews are available (limited to 3 per account).
• All prices are in USD.

• If a job fails during processing, you may retry up to 5 times at no extra cost.
• If retries are exhausted, you may request a full refund from the job page.
• Refunds for successfully completed jobs are not available.
• Refunds are processed via Stripe to the original payment method.

Photos, thumbnails, and reports are automatically deleted 7 days after job completion. You should export your results before this deadline. We are not responsible for data loss after the retention period.

You agree not to:

• Submit illegal, harmful, or abusive content.
• Attempt to access other users' data or accounts.
• Reverse-engineer, scrape, or abuse the Service or its APIs.
• Use the Service for any purpose that violates applicable law.

To the maximum extent permitted by law, Nisqure Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid for the specific job in question.

We aim to provide reliable service but do not guarantee 100% uptime. We may perform maintenance or updates that temporarily affect availability. We will endeavour to provide advance notice of planned downtime.

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
